Terms of Service
Last updated October 15, 2026
1. Who we are
Mudbath is a small, members-only community website. It's run by Leah Rosenburg ("we", "us", "Mudbath"). By asking to join or using the site, you agree to these terms. If you don't agree, don't use Mudbath.
2. Eligibility
You must be 13 or older to join. If you're under 13, don't sign up. If we find out an account belongs to someone under 13, we suspend it and delete it.
We take your word for your age. We don't verify it. If you're under 18, you confirm a parent or guardian has agreed to these terms on your behalf, including the indemnity in section 14.
3. Membership
Anyone can ask to join, and every member is approved by hand. Membership is a privilege, not a right, and we can decline or revoke it for any reason.
One account per person. Keep your login to yourself. You're responsible for anything done with your account, including by someone you gave access to.
4. Your photos and content
You keep the copyright in everything you post. Posting doesn't transfer ownership to us.
By posting, you give us a non-exclusive, worldwide, royalty-free licence to store, host, reproduce, resize, transcode, cache and display your content, and to let our service providers (like our CDN) do the same. This licence ends when you delete the post, except for backups and anything already cached.
You confirm that:
- you own the content, or have permission to post it;
- it isn't defamatory, and doesn't breach anyone else's rights;
- if a face or a recognisable body is in it, you have that person's permission to post it;
- if you're under 18, you have your guardian's permission to post photos of yourself.
5. What you can't post
Talking about self-harm, scars and recovery in words is welcome here. These aren't:
- Photos or videos of wounds, blood, cuts or other injuries.
- Details of how anyone hurt themselves, or anything that encourages someone to.
- Nudity or sexual content.
- Anything you don't have the right to post.
- Spam, scraping, or trying to break the site.
6. This is not medical advice
Mudbath is not a medical service or a crisis service. Nothing here, from us or from members, is diagnosis, treatment, or medical advice. If someone tells you something about your health, that's an opinion. If something worries you, see an actual clinician.
If you're in danger or thinking about hurting yourself, call or text 988 (the Suicide & Crisis Lifeline, in the US), or call 911.
We don't verify anyone's credentials. Members who sound like they know what they're talking about may not.
7. Moderation
We may remove, hide, or put a content warning on anything, at any time, for any reason, with or without telling you. We may also leave things up that you'd have removed.
We're not the author of what members post. We're a place where it sits. Our moderation is discretionary and inconsistent: sometimes we'll catch something, sometimes we won't. You can't rely on us having reviewed any given post.
8. Copyright
If you think something on Mudbath infringes your copyright, send a notice to our designated agent. The full process, including counter-notices, is on our Copyright page.
9. Repeat infringers
We log every notice. A member picks up a strike when a valid notice is upheld against one of their posts. Three strikes terminates the account, sooner if they repost the same work or ignore notices. Fair use counts for something: if we think a repost was lawful, it isn't a strike. The call is ours, but we'll tell you why we made it.
10. Other people's content
Other members post here. We don't check it, endorse it, or guarantee it. If you rely on something a member said and it turns out wrong, that's between you and them, though section 13 applies to us either way.
11. Ending your membership
You can leave whenever you want. To delete your account, email contact@mudbath.app and we'll delete it. We can terminate or suspend you at any time, for any reason.
If we terminate you, your content may be deleted. Back it up if you care about it.
12. Availability, no warranty
Mudbath is provided as is and as available. We don't promise it'll work, stay up, stay fast, or keep your data. We're a small site run by one family. Things break. Backups exist but aren't a guarantee.
Back up your own photos. If we lose them, you lose them.
13. Limitation of liability
To the fullest extent the law allows:
- We're not liable for indirect, incidental, special, or consequential damages, or for lost data, lost photos, lost profits, or lost goodwill.
- Our total liability to you is capped at $50.
- Some jurisdictions don't allow some of these limits, so parts may not apply to you.
14. Indemnity
If someone makes a claim against us because of something you posted or something you did on Mudbath, you agree to cover our reasonable costs of dealing with it, including legal costs.
If you're a minor, your parent or guardian agrees to this on your behalf.
15. Changes to these terms
We may change these terms. When we do, we'll update the date at the top and post a note. Continued use after a change means you accept the new version. If you don't like it, you can leave.
16. Governing law and disputes
These terms are governed by the laws of the State of Colorado, USA.
Disputes go to the state or federal courts sitting in Douglas County, Colorado. Either of us can take a small claim to a small claims court instead.
If you're outside the United States, you agree that Colorado law applies and that Colorado courts can hear the dispute.
17. Miscellaneous
If a clause turns out unenforceable, the rest survives. Our not enforcing something once doesn't mean we've waived it. These terms plus the Privacy Policy are the whole agreement between us.
We may transfer these terms, along with the site, to an entity we form or to a successor. You can't transfer yours without our say-so.
Sections 4, 6, 7, 13, 14 and 16 survive termination.
